Australia sets new crypto platform rules for 2027
Australia’s ASIC seeks feedback on crypto platform rules covering licensing, capital, custody, and trading. New regulations take effect April 2027. Consultation closes November 27, 2026.
Australia is moving forward with comprehensive regulations for digital asset platforms, set to take effect in April 2027. The Australian Securities and Investments Commission (ASIC) has released Consultation Paper 392, seeking industry feedback on proposed standards for licensing, capital requirements, custody, trading conduct, and customer asset protection. Under the new rules, platforms must obtain an Australian financial services licence, provide customer disclosure documents, and comply with strict standards for asset holding, transactions, and settlements. Three capital models are being considered, including one requiring at least $9.7 million AUD in net tangible assets. Platforms will also need to report wallet structures quarterly and retain records for seven years. Offshore custody will be permitted if emergency access protocols for private keys are in place. The consultation period ends November 27, 2026, and current operators have until October 7, 2027, to apply for new or amended licences. These measures aim to align Australia’s digital asset framework with global standards and enhance investor protection.
