Schwartz criticizes regulatory uncertainty
David Schwartz compared Ripple’s SEC case to a firearms lawsuit, arguing both show how unclear regulations create compliance uncertainty and enforcement risks, calling such practices unfair across industries.
David Schwartz, co-creator of the XRP Ledger and former Ripple CTO, has reignited the debate over regulatory uncertainty by comparing Ripple’s legal battle with the SEC to a Connecticut firearms lawsuit involving Glock. Schwartz argues that both cases highlight a fundamental problem: companies often struggle to determine if their actions or products are legally compliant due to vague regulations. He criticized regulators for imposing obligations without providing clear guidance, making compliance difficult and exposing businesses to enforcement risks. Schwartz’s comments, prompted by legal documents shared by attorney Kostas Moros, emphasize that this issue extends beyond the crypto sector and affects multiple industries. Schwartz described such regulatory approaches as “grossly unfair,” noting that unclear rules force companies to operate in a climate of uncertainty. Although the Ripple-SEC case concluded in August 2025 with a significant civil penalty and injunction, Schwartz maintains that the broader issue of regulatory clarity remains unresolved.
