CFTC secures $288M judgment in EminiFX Ponzi case

A federal court ordered Eddy Alexandre and EminiFX to pay $288M for a Ponzi scheme. Over $98M has been returned to investors. The CFTC imposed permanent bans and prioritized victim restitution.

A federal court has ordered Eddy Alexandre and his firm EminiFX to pay over $288 million after finding them liable for operating a Ponzi scheme. The Commodity Futures Trading Commission (CFTC) led the case, resulting in a judgment that includes $228.58 million in restitution, $15.05 million in disgorgement, and a $45.15 million civil penalty. EminiFX raised more than $262 million from over 25,000 investors by promising weekly returns of up to 9.99% through non-existent trading technology. In reality, actual trading resulted in net losses exceeding $49 million, and funds from new investors were used to pay earlier participants. The court imposed permanent bans on Alexandre and EminiFX from engaging in commodities-related activities. As of July 2026, over $98 million has been returned to more than 28,000 investors. The ruling prioritizes investor claims over government penalties and underscores the CFTC's commitment to combating crypto-related fraud.
