Wisconsin sues crypto firms over prediction markets

Wisconsin sued five major crypto platforms, alleging their prediction markets are illegal gambling and seeking to block their services, highlighting a state vs. federal regulatory clash.

Wisconsin has filed lawsuits against five major prediction market platforms—Kalshi, Coinbase, Polymarket, Robinhood, and Crypto.com. The state alleges that these platforms' event contracts are illegal gambling under state law, rather than legitimate financial instruments. According to Wisconsin, the platforms disguise gambling as financial tools to bypass regulations, allowing users to bet on real-world outcomes like sports and receive fixed payouts. The lawsuits, filed in Dane County, target different segments of the prediction market ecosystem and seek to halt these services within Wisconsin. The central legal question is whether such contracts should be regulated by state gambling laws or fall under federal oversight by the Commodity Futures Trading Commission (CFTC). Both sides cite conflicting legal precedents, and the outcome could set a significant precedent, potentially reaching the Supreme Court. Wisconsin is seeking injunctions and penalties for past violations.
