CFTC grants Phantom Wallet regulatory relief

CFTC’s no-action letter lets Phantom Wallet link users to regulated derivatives markets without broker registration, signaling a more flexible U.S. regulatory approach to DeFi platforms.

The U.S. Commodity Futures Trading Commission (CFTC) has granted Phantom Technologies, the developer of Phantom Wallet, a no-action letter. This allows Phantom Wallet to provide users access to regulated derivatives markets without registering as a broker. The relief specifically applies to Phantom’s non-custodial software, which connects users directly with CFTC-registered entities, such as futures commission merchants and designated contract markets. Under this decision, the CFTC will not take enforcement action against Phantom or its employees for not registering as an introducing broker, provided certain conditions are met. This move marks a significant shift in the U.S. regulatory approach to decentralized finance (DeFi), offering both relief to Phantom and optimism for the broader DeFi sector. Phantom can now expand its services while ensuring compliance, as users retain control over their assets and interact directly with registered exchanges. This outcome is considered unprecedented for non-custodial interfaces and results from proactive engagement with regulators, providing much-needed clarity for DeFi platforms operating within current regulations.
